These Terms of Service ("Terms") are a binding agreement between you and HappyGoLucky Studios LLC ("HappyGoLucky Studios," "we," "us," or "our") and govern your access to and use of the ProjectPinkOwl website at projectpinkowl.com (the "Site").

Please read these Terms carefully. They include a limitation of our liability (Sections 8 and 9) and a section on dispute resolution (Section 12). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

2. About the Site

ProjectPinkOwl is the corporate website for our family of brands. The Site is a basic informational website that describes our company and links to our brand websites. The Site does not offer account registration, logins, purchases, or interactive user features. Our brand websites and products are governed by their own separate terms and policies.

We may change, suspend, or discontinue the Site or any part of it at any time, with or without notice.

3. Eligibility

The Site is intended for a general adult audience and is not directed to children under 13. By using the Site, you represent that you are able to form a binding agreement with us under applicable law.

4. Acceptable use

You agree not to:

  • Use the Site in violation of any law or regulation, or to infringe anyone's rights.
  • Attempt to reverse engineer, scrape, overload, disrupt, probe, or bypass the security of the Site.
  • Use bots, automation, or scripts to access the Site except as we expressly permit.
  • Copy, reproduce, republish, or commercially exploit the content or branding of the Site without our written permission, except as allowed by law.
  • Use the Site to transmit malware or to harm, defraud, or mislead others.

5. Intellectual property

The Site and its contents, including text, graphics, logos, design, and the ProjectPinkOwl name and marks and the names and marks of our brands, are owned by HappyGoLucky Studios or its licensors and are protected by intellectual property laws. We grant you a limited, personal, non exclusive, non transferable, revocable license to view the Site for your own informational use. We reserve all rights not expressly granted.

6. Third party links and brand sites

The Site links to our brand websites and may link to other third party sites. We do not control those sites and are not responsible for their content, products, availability, or practices. Your use of a linked site is governed by that site's own terms and policies. A link does not mean we endorse a third party.

7. Informational content only

The content on the Site is provided for general informational purposes only. It is not professional advice of any kind, and you should not rely on it as such. We may update or change Site content at any time without notice, and we do not warrant that the content is complete, current, or accurate.

8. Disclaimer of warranties

To the fullest extent permitted by law, the Site is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non infringement. We do not warrant that the Site will be uninterrupted, secure, error free, or free of harmful components. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

9. Limitation of liability

To the fullest extent permitted by law, HappyGoLucky Studios and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of or inability to use the Site.

To the fullest extent permitted by law, our total liability for all claims relating to the Site will not exceed fifty US dollars (US $50).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

To the fullest extent permitted by law, you agree to indemnify and hold harmless HappyGoLucky Studios and its members, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Site or your violation of these Terms or any law or third party right.

11. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide notice through the Site. Your continued use of the Site after changes take effect means you accept the revised Terms.

12. Dispute resolution and governing law

Informal resolution first. Before starting any formal proceeding, you agree to contact us at hello@projectpinkowl.com and give us 30 days to try to resolve the dispute informally.

Governing law and venue. These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of laws rules. Any dispute that is not resolved informally will be brought exclusively in the state or federal courts located in Wyoming, and you consent to their jurisdiction. Nothing in this section limits any mandatory consumer protections available to you under the laws of the place where you live.

13. General terms

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Site and supersede any prior agreements.
  • Severability. If any provision is found unenforceable, the rest of these Terms remain in effect.
  • No waiver. Our failure to enforce any provision is not a waiver of it.
  • Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
  • No third party beneficiaries. These Terms do not create any third party beneficiary rights.
  • Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
